Agreement to These Terms

By accessing this website, sending a message to the sanctuary office or booking a programme, you agree to these Terms of Service. If you do not agree, please do not use the site and do not complete a booking. The terms form a binding agreement between you and KEA HAMLET, LLC.

These terms apply together with the Privacy Policy published on this website. Where the two documents overlap, the Privacy Policy controls how personal information is handled and these terms control the use of the site and the arrangements for programmes.

A booking may also be covered by a short confirmation note sent from the office. If the confirmation note contains a specific arrangement, such as a meeting time or a smaller party size, that arrangement applies to the booking in addition to these terms. In the event of a conflict, the specific note governs for that booking.

About the Company

KEA HAMLET, LLC is a company registered in the United States that operates a sanctuary village trust for a high country parrot colony. The registered and operating address is 10610 S Jordan Gtwy Ste 200, South Jordan - 84095-3948, United States (US). The office can be reached by email at accounts@keahamlet.mom and by telephone at +19453810463.

The website is operated by the same organisation and by the developer named on the homepage. The programmes described on the services page are delivered by keepers and field staff who work from the South Jordan office and the sanctuary hut.

Nothing in these terms makes a visitor an employee, agent, partner or representative of the Company. A visitor who joins a survey line, a planting day or a dawn watching takes part as a guest and not as a member of staff.

Eligibility and Capacity

This website is intended for adults. A person under the age of majority in their home jurisdiction should use the site only with the involvement of a parent, guardian or teacher who accepts these terms on that person behalf.

A booking may be made by an adult on behalf of a party that includes children. The adult who makes the booking is responsible for the party and for ensuring that the group can follow the safety briefing that is given at the hut.

By making a booking you confirm that you have the legal capacity to enter into this agreement and that the information you supply is accurate to the best of your knowledge. If information changes before the visit, please tell the office so that the party can be planned correctly.

Permitted Use of the Website

You may read the pages, print a copy for personal reference and use the contact form to send a genuine message to the office. You may share a link to the site or quote a short passage with clear attribution to KEA HAMLET, LLC.

You may not present the site or its content as your own work, and you may not use the sanctuary name in a way that suggests an endorsement that has not been given. Educational use is welcome, and the office is glad to answer a request for permission in writing where a larger use is planned.

Access is provided on an ordinary basis and may be interrupted for maintenance. We do not guarantee that every page will be available at every moment, and we may change or remove a page when the information on it is no longer accurate.

Prohibited Conduct

The site and the sanctuary depend on careful, quiet behaviour. The following conduct is not permitted and may lead to a refusal of access or a cancellation of a booking.

This list is not exhaustive. A keeper may ask a visitor to stop a behaviour that disturbs the colony or endangers a party, and a visitor is expected to follow that instruction without argument. Safety decisions in the field belong to the keeper leading the group.

Sanctuary Programmes

The Company offers six programmes: guided dawn watchings, nesting ledge sponsorships, alpine habitat restoration, visitor center programs, community science surveys and school outreach visits. Each programme is described on the services page, and each description is a summary rather than a complete specification.

Programmes depend on weather, ground conditions, the breeding state of the colony and the number of keepers available. A programme may be shortened, moved indoors or postponed for the welfare of the birds. Where a change is necessary, the office will explain the reason and offer the nearest available alternative.

We do not promise that a visitor will see a particular animal, a particular behaviour or a particular number of birds. The colony is wild and its movements are not directed by the sanctuary. What we do promise is an honest attempt to place you where the work is happening and a guide who can explain what you are seeing.

Bookings and Confirmations

An enquiry is not a booking. A booking exists once the office has confirmed a date, a time and a party size in writing. Until that confirmation arrives, the date remains open to other parties.

Please send the details that a keeper needs to plan the visit: the number of people, any accessibility needs, the season you prefer and a reliable contact address. The office may ask a short follow up question before confirming, particularly for parties that include children or visitors who will walk slowly.

Group sizes are limited by the colony rather than by convenience. If a party is larger than the limit, the office may split it across several dates or offer a center programme for part of the group. We would rather decline a request than crowd a nesting face.

Confirmation notes should be kept for the day of the visit and shown at the hut if asked. A confirmed place is personal to the party named in the note and may not be sold or transferred without the agreement of the office.

Fees, Sponsorships and Donations

Some programmes carry a fee that covers the direct cost of running the visit, including guiding time, materials and trail upkeep. Sponsorships are contributions that underwrite a nesting ledge and the survey work around it. The office explains the current fee or contribution before a booking is confirmed and does not take payment through this website.

A sponsorship is a contribution to a programme and not an investment, a security or a financial product. It does not confer ownership of a bird, a ledge or any part of the sanctuary, and it does not create a right to a particular outcome. The Company keeps sponsorship records and reports honestly on what the funds supported.

Where payment is made for a programme and the programme is cancelled by the Company before any part has been delivered, the fee is returned in full or applied to a replacement date at the choice of the visitor. Where a programme has already been delivered, a refund is not owed simply because the wildlife behaved differently from expectation.

Donations to the sanctuary are used for the purposes described at the time of the request. The office does not accept a donation that is offered with a condition that would compromise the welfare of the colony or the independence of the field record.

Changes and Cancellations

If you need to change or cancel a booking, please tell the office as early as possible so that another party can be offered the place. A short notice means a keeper does not wait at the hut for a group that will not arrive.

Where a visitor cancels well before the date, the office will usually offer a replacement date or a return of any fee that has been paid. Where a cancellation comes at short notice, the office may retain a portion that covers the cost already committed, such as a guide who has been assigned or material that has been prepared.

The Company may cancel or shorten a programme for weather, ground conditions, a colony nesting event or a safety concern. In that situation the office will act reasonably, explain the decision and offer a replacement date where one is possible.

Dawn watchings are particularly sensitive to weather. Fog, heavy rain and high wind can make the trail unsafe and can disturb the colony. A decision to move a programme indoors is a decision about safety and welfare, not a reflection on the visitor.

Field Safety and Visitor Duties

The sanctuary slope is a working outdoor site. Visitors are expected to wear suitable footwear, carry water and a warm layer, and follow the briefing given at the hut. The keeper leading a party has authority over the route, the pace and the decision to turn back.

Please tell the keeper about any medical condition that could affect you during a walk. Information is shared only where it is needed to keep the party safe. A visitor who becomes unwell should stop and say so rather than continue in silence.

Children remain the responsibility of the adult who brings them. The sanctuary does not provide supervision for children and does not accept a duty to keep a child within the group beyond the ordinary care that a reasonable guide would take.

Walking on uneven ground carries an ordinary risk of a slip or a strain. By joining a walk you accept the ordinary risks of an outdoor visit in a mountain environment, and you agree to follow the safety instructions that are given.

Wildlife and Colony Protection

The colony comes first. A programme may be altered, shortened or cancelled in order to protect a nesting ledge, a chick or the calm of the slope. A keeper who judges that a party is too close or too loud will move the party back, and that decision is final for the day.

Feeding is managed only from the designated feeding station and only by staff. Visitors may not offer food, water or objects to a bird. Photographs should be taken from the marked position without flash, and no visitor may leave the trail to reach a ledge.

If a bird approaches a visitor, the correct response is to stay still and let it move on. A mountain parrot is curious and strong, and a snatched hand or a dropped bag can cause injury to both the bird and the person. The guide will explain the correct behaviour before the party enters the colony area.

Any observation that suggests injury, distress or unusual behaviour should be reported to a keeper. Do not attempt to handle a wild bird yourself, and do not remove a bird from the slope even if it appears to be in difficulty.

School and Group Visits

School outreach visits are arranged with a named member of school staff who acts as the organiser. The organiser confirms the number of pupils, the age range, the date and the materials needed, and remains the contact for the school before and after the visit.

The school is responsible for its own pupils, for any consent required by school policy and for supervision during the session. A keeper leads the lesson but does not replace the ordinary duty of a teacher to oversee a class.

Group visits to the visitor center follow the same principle. The organiser confirms the party, briefs the group on quiet behaviour and remains responsible for the group while it is on site. Where a group cannot meet the quiet rules, the office may adapt the session to the center hall rather than the slope.

Materials supplied for a school session remain the property of the Company unless they are described as gifts. A school is welcome to keep a copied log page for classroom use with clear attribution.

Intellectual Property

The text, layout, illustrations and code of this website belong to KEA HAMLET, LLC or are used with permission. The sanctuary name, the village trust name and the visual identity of the site are protected by the same rights. Nothing in these terms transfers ownership of any of it to a visitor.

The field notes, nesting register and banding log are the working property of the sanctuary. A visitor may read a copied page at the hut, and a sponsor may receive a written update, but no visitor acquires a right to publish the register or to use the names of individual birds for commercial purposes.

You may quote a short passage from this website with clear attribution and a link to the page. For a longer extract, an image or a classroom pack, please write to the office and describe the intended use. Permission is often given and is always confirmed in writing.

Messages and Submitted Content

When you send a message through the contact form or by email, you confirm that the content is your own or that you have the right to share it. You grant the Company permission to read the message, reply to it and keep it as part of the ordinary office record described in the Privacy Policy.

Please do not send confidential material that is not needed for the enquiry. Do not send identity documents, financial details or the personal information of another person without that person agreement. The office will ask for specific documents only when there is a clear reason and will explain how they will be handled.

We may decline to publish, quote or act on a message that is abusive, misleading or unrelated to the work of the sanctuary. A message that threatens a person or an animal may be reported to the appropriate authority.

Third Party Links and Services

The website may contain links to mapping services, mail providers and partner organisations. These links are offered for convenience. The Company does not control the content or the practices of a third party site and does not accept responsibility for them.

If you follow a link and are asked for personal information, read the privacy statement of that site before you continue. A link from this site does not mean that the Company endorses every practice at the destination.

Where a programme is delivered with a partner, the partner may have its own terms. The office will tell you when a partner is involved and will point you to the relevant document before the booking is confirmed.

Disclaimer of Warranties

The website and its content are provided on an as available basis. To the fullest extent permitted by law, the Company makes no warranty that the site will be uninterrupted, free of error or free of harmful components, and no warranty that the information on it is complete or current at every moment.

The sanctuary is a working outdoor site and wildlife is unpredictable. The Company does not warrant that a programme will produce a particular sighting, a particular photograph or a particular learning outcome. Descriptions of the colony are written in good faith from field observation and may change with the season.

Nothing in these terms excludes a warranty or a right that cannot lawfully be excluded. Where a law in your jurisdiction gives you a non-excludable right, that right remains in force.

Limitation of Liability

To the fullest extent permitted by law, the Company is not liable for indirect, incidental, special or consequential loss arising from the use of this website or from a programme, including loss of profit, loss of opportunity or loss of data. The Company is not liable for a loss caused by a third party service or by a failure of the visitor own equipment or connection.

Where liability cannot be excluded, the total liability of the Company for a claim connected with a programme is limited to the fee paid for that programme. Where no fee was paid, the liability is limited to a reasonable amount that reflects the nature of the claim and the role of the Company.

Nothing in this section limits liability for fraud, for wilful misconduct or for any matter for which liability cannot be limited by law. A visitor who is injured through the negligence of the Company in the field retains every right that the law provides.

Indemnity

You agree to indemnify the Company against a reasonable loss, cost or claim that arises from your breach of these terms, from your misuse of the website or from damage you cause at the sanctuary. This obligation does not apply to a loss caused by the Company own negligence.

If a claim is made, the office will notify you promptly and will allow you to take part in the response where the law permits. You agree to cooperate in good faith with any reasonable request for information about the events that led to a claim.

The indemnity is intended to cover genuine third party harm, such as damage to a trail marker, a sign or the property of another visitor. It is not intended to discourage a visitor from raising a legitimate concern about safety or service.

Privacy and Personal Information

Personal information is handled according to the Privacy Policy published on this website. That policy explains what is collected, why it is held, how long it is kept and how a person can ask for access, correction or deletion.

By using the site you acknowledge that information will be handled in the United States and that it may be processed by a supplier that supports the website or the email system. The Privacy Policy describes the safeguards that apply to such processing.

If there is a conflict between these terms and the Privacy Policy on a question about personal information, the Privacy Policy governs. The office is happy to answer a privacy question directly before a booking is made.

Governing Law and Disputes

These terms are governed by the laws of the State of Utah and the applicable laws of the United States, without regard to conflict of law rules. A dispute that cannot be resolved by discussion may be brought before a court of competent jurisdiction in Utah.

Before a formal step is taken, we ask that you write to the office and describe the issue. Many concerns are settled in a single exchange, and a written account helps both sides understand what happened and what would resolve it.

If a provision of these terms is found to be invalid, the rest of the terms remain in force. The invalid provision will be read down to the extent necessary to give it effect, where that is possible under the law.

Suspension and Termination

The Company may suspend or end access to the website or to a programme where these terms have been breached, where a visitor behaves abusively or where continuing would put a person, a bird or the colony at risk. A decision in the field may take effect immediately.

A suspension of a booking does not remove an obligation that has already arisen, such as a fee that is owed or a record that must be kept. A visitor may end this agreement at any time by ceasing to use the site and by not completing a booking.

Where a booking is ended by the Company for a reason that is not the fault of the visitor, the office will offer a replacement date or a return of the fee as described in the section on changes and cancellations.

General Provisions

These terms, together with the Privacy Policy and any confirmation note for a booking, form the whole agreement between the visitor and the Company on the matters they cover. An earlier statement or a conversation does not add a term unless it is written into the confirmation note.

A failure to enforce a provision on one occasion is not a waiver of that provision on a later occasion. A delay in responding to a breach does not prevent the Company from acting on the same breach when it continues.

You may not transfer your rights under these terms without written agreement from the office. The Company may transfer its rights to a successor organisation that continues the sanctuary work, provided that the Privacy Policy remains in force for information already collected.

Headings are used for convenience and do not affect the meaning of the text. A reference to a page on this website includes a later version of that page while these terms remain in force.

Changes to These Terms

These terms are reviewed at least once a year and whenever a programme or a legal requirement changes. When the text changes, the effective date at the top of this page is moved forward and a note is placed in the office log describing the change.

A change applies to a booking made after the new effective date. A booking that was confirmed before the change continues under the terms that applied at the time of confirmation, unless the new terms are more favourable to the visitor or a change in the law requires otherwise.

The current version is always the one published here. A printed copy can be requested from the office and is kept at the hut for visitors who prefer to read on paper before a visit.

Contact Details

Questions about these terms, a booking, a cancellation or a programme should be sent to the sanctuary office. The office is staffed during published business hours and messages are read by a keeper.

The developer of this website can be reached through the same office address. If you are writing about the website rather than a programme, please say so in the subject line so that the message reaches the right desk.
